Wills and Trusts

To be legally valid, a written will must be signed by the testator (person making the will) and witnessed by at least two individuals who are present at the same time, as stated in the California Probate Code Section 6110. A revocable living trust allows you to maintain control of your assets during your lifetime. It also allows those assets to pass to your beneficiaries after your death without going through the lengthy probate process. Probate and Trust Litigation

When a person passes away, the estate typically enters probate, the court-supervised process of authenticating a will and distributing assets. The California Superior Court oversees the proceedings to ensure creditors are paid, and beneficiaries receive their rightful shares.

The probate administration process generally involves the following:

  • Filing a petition for probate in the county where the decedent resided
  • Identifying and inventorying all estate assets
  • Notifying known creditors and the public of the proceedings
  • Paying all valid debts, funeral expenses, and taxes from estate funds
  • Distributing the remaining property to beneficiaries or heirs

During this process, the personal representative must work with a court-appointed probate referee to establish the fair market value of non-cash assets, such as real estate. This valuation is recorded on the Inventory and Appraisal form, a mandatory court filing that confirms the total value of the estate.

Disputes can arise during this time, leading to probate and trust litigation. Common issues include challenges to the will’s validity based on lack of capacity, allegations of undue influence, and claims of breach of fiduciary duty. A trustee has a legal duty to administer the trust solely in the interests of the beneficiaries under California Probate Code Section 16002. If a trustee fails to meet this standard or engages in self-dealing, beneficiaries may pursue legal action to remove the trustee or recover lost assets.
