My house was already sold at foreclosure. Is it too late to challenge it in California?
Based on an interview with Josué Cristóbal Guerrero, Founding Partner, recorded .
The short answer
Not always, but most people will not qualify. There are specific causes of action for a wrongful foreclosure after the sale. Generally, though, you must have offered to pay off the total loan, which is called tender. There are exceptions to that rule, and in our experience they are narrow and rarely apply.
It's important to meet with someone that you trust is going to give you a straight answer.
Be careful who you pay to find out
Whether you have a case has to be walked through factor by factor with an attorney. Be wary of anyone who tells you that you have a case before doing that. People can spend a great deal of additional money trying to save a house that is already gone.
Separately, Greenacre Law does not offer loan modification, forbearance negotiation or foreclosure rescue services, and we do not accept advance fees for any such service.
