What is Estate Planning?

Estate Planning is the process of working through all the practical, legal, and tax issues associated with a death ahead of time to protect family assets and meet individual goals of charity, inheritance, and any other final wishes after death.

The most common Estate Plan includes:
  • A Living Trust to transfer assets to their loved ones while avoiding probate
  • A Pour-over Will to make sure any overlooked assets of the estate end up in the Trust
  • A Durable Power of Attorney to authorize a trusted friend or family member to make critical financial decisions for you if you are incapacitated prior to death
  • An Advanced Health Care Directive so that hospitals, doctors, and other health care providers are put on notice of what treatments and life savings methods you will allow in your final days
  • Various Deeds transferring Real Estate into your Trust
  • Various Assignment of Interest forms transferring your LLCs, Corporations, or other entities into your Trust
Greenacre Law can prepare all of these documents for a low flat fee or even review your existing Estate Planning documents to make sure they accomplish your goals.
In addition to basic Estate Planning Packages, Clients may have advanced Estate Planning issues related to high-net-worth status or unique title or ownership issues. Advanced issues may include:
  • Proposition 19 Planning and Avoidance.
  • Land Trusts.
  • Irrevocable Maintenance Trusts.
  • Sub-Trusts and other “Trusts-within-Trusts.”
  • Estate exemption harvesting for estates exceeding $11.2 Million per person or $22.4 Million for married couples.
